1. Agreement to These Terms
These Terms and Conditions (the "Terms") form a binding legal agreement between you ("you," "your," or "User") and Bellwether Media LLC, a Delaware limited liability company doing business as and operating the brand "Predictive Markets TV" ("Predictive Markets TV," the "Company," "we," "us," or "our").
These Terms govern your access to and use of all content, broadcasts, programs, livestreams, recordings, video and audio clips, episodes, scorecards, segments, written posts, newsletters, comments, community spaces, websites, applications, social media channels, and any other product, service, or material that we make available under or in connection with the Predictive Markets TV brand, on any platform and through any distribution channel, now or in the future (collectively, the "Service" and, where referring to the material itself, the "Content").
By accessing, viewing, streaming, downloading, sharing, or otherwise interacting with any part of the Service — on our website, on any third-party platform (including but not limited to YouTube, Facebook, LinkedIn, TikTok, X, Instagram, or any podcast or streaming service), or anywhere else — you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Service.
2. Definitions
- "Content" means all material made available through the Service, including commentary, opinions, analysis, discussion, predictions, the segments referred to as the "Reckoning," the "Body," and the "Board," any scorecards, grades, or call-tracking, and all video, audio, text, graphics, and data.
- "Calls" means any prediction, opinion, forecast, grade, ranking, characterization of probability, or statement about what a prediction market is or may be implying, expressed anywhere in the Content.
- "Prediction Markets" means event-contract, prediction, forecasting, or similar platforms and the contracts traded on them, including Polymarket and Kalshi, and any comparable platform.
- "Third-Party Platforms" means any website, application, exchange, marketplace, or service operated by anyone other than us.
- "User Content" means any material you submit, post, or transmit through the Service.
3. The Nature of the Content — Opinion and Entertainment Only
This is the most important section of these Terms. Read it carefully.
3.1 Entertainment, commentary, and education only. All Content, including every Call, is provided solely for general informational, educational, commentary, and entertainment purposes. It reflects the personal opinions and subjective viewpoints of the hosts, guests, and contributors at the time of recording or publication.
3.2 Not financial, investment, trading, or professional advice. Nothing in the Content is, or should be construed as, financial, investment, securities, commodities, derivatives, trading, or brokerage advice; a recommendation, endorsement, signal, tip, or solicitation; an offer or solicitation to enter into any transaction; legal, tax, accounting, or regulatory advice; or a statement that any transaction, market, or platform is suitable, lawful, or available for you.
3.3 No recommendations and no personalized advice. We do not know you, your circumstances, your financial situation, your objectives, or your risk tolerance. We are not your broker, dealer, adviser, fiduciary, agent, or representative.
3.4 Calls are opinions, not predictions of fact. Calls are inherently uncertain and frequently wrong. Any scorecard, grade, "Reckoning," batting average, or record of prior Calls is entertainment and self-commentary, is not audited or verified, and must not be relied upon as a track record. Past Calls do not indicate or guarantee future results.
3.5 No reliance. You agree that you will not rely on any Content or Call as a basis for any financial, trading, betting, purchasing, or other decision. You are solely responsible for your own decisions and their consequences.
3.6 Do your own research and consult professionals. Before making any financial, trading, or other decision, consult a licensed and qualified professional.
4. Assumption of Risk
You acknowledge that trading, investing, wagering, and participating in Prediction Markets, crypto assets, securities, commodities, and similar activities involve substantial risk, including the risk of losing some or all of the money or assets involved. You voluntarily and knowingly assume all such risks, and accept full and sole responsibility for evaluating the merits, risks, and legality of any market, platform, contract, or transaction you choose to engage with.
5. Eligibility, Age, and Jurisdiction
You must be at least 18 years old (or older if a higher age applies where you are) to access the Service. Prediction Markets, event contracts, crypto assets, and related activities are regulated differently from place to place and are restricted, prohibited, or illegal in some jurisdictions. You are solely responsible for determining whether your access to the Content and any action you take is legal where you are.
6. Affiliate, Referral, and Sponsorship Disclosure
We may earn money from links and referrals. The Company may receive referral fees, affiliate commissions, revenue share, bounties, sponsorship, or other compensation when you click a link, sign up, register, deposit, trade, or otherwise act on a Third-Party Platform, including Prediction Markets such as Polymarket and Kalshi.
You should assume that any link to, or mention of, a Third-Party Platform may be one from which we earn compensation, and that this creates a financial incentive for us. Our receipt of compensation, and any mention of a platform, is not an endorsement, recommendation, or assurance of that platform's safety, legality, suitability, or performance.
7. Conflicts of Interest
The Company, its owners, hosts, guests, contributors, employees, and affiliates may hold, acquire, or dispose of positions, contracts, tokens, or other interests in the markets, contracts, events, or assets discussed in the Content, at any time. Assume the people producing the Content may have a financial or personal interest in the subjects they discuss and that their commentary may be influenced by those interests.
8. Third-Party Platforms, Links, and Content
The Service contains references and links to Third-Party Platforms and to content, data, and services we do not own or control. We do not endorse, guarantee, or assume any responsibility for any Third-Party Platform. Any prices, odds, probabilities, or market data shown or referenced in the Content may be delayed, inaccurate, incomplete, or out of date.
9. Intellectual Property
The Service and all Content (excluding User Content and third-party material) are owned by or licensed to the Company and are protected by copyright, trademark, and other laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Content for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, sell, license, modify, create derivative works from, scrape, data-mine, or commercially exploit any Content without our prior written consent, except as permitted by applicable law.
10. User Content and Community Conduct
If the Service allows you to submit comments, messages, or other User Content, you are solely responsible for it. You grant the Company a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, display, adapt, and create derivative works from your User Content in connection with operating and promoting the Service. You must not post anything unlawful, fraudulent, defamatory, harassing, hateful, obscene, infringing, or malicious. We may, but are not obligated to, monitor, moderate, edit, or remove any User Content.
11. Disclaimer of Warranties
The Service and all Content are provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Content is accurate, complete, reliable, current, lawful in your jurisdiction, or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, the Company and its owners, members, managers, officers, employees, hosts, guests, contributors, agents, and affiliates (the "Company Parties") will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, trading losses, investment losses, betting or wagering losses, losses on any Prediction Market or Third-Party Platform, lost opportunities, or tax or regulatory consequences, arising out of or relating to the Service, the Content, any Call, or any decision or action you take.
To the fullest extent permitted by law, the total aggregate liability of the Company Parties for all claims will not exceed the greater of (a) the total amount you paid us, if any, in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).
13. Release
To the fullest extent permitted by law, you release and forever discharge the Company Parties from any and all claims, demands, damages, losses, and liabilities of every kind, known or unknown, arising out of or in any way connected with any decision, transaction, trade, wager, or other action you take in reliance on, or otherwise in connection with, the Content or any Call. If you are a California resident, you waive California Civil Code Section 1542, and you waive any comparable provision of any other jurisdiction.
14. Indemnification
You agree to indemnify, defend, and hold harmless the Company Parties from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service; any decision or action you take in connection with the Content; your User Content; your violation of these Terms; or your violation of any law or third-party right.
15. Forward-Looking and Predictive Statements
The Content is full of forward-looking and predictive statements — including the Calls — which by their nature concern uncertain future events and are not guarantees. Actual events and outcomes will differ, often materially. We undertake no obligation to update any Content or Call.
16. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we handle information.
17. Changes to the Service and These Terms
We may modify, suspend, or discontinue any part of the Service at any time without notice or liability. We may revise these Terms at any time by posting an updated version with a new "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
18. Termination
We may suspend or terminate your access to the Service at any time, for any reason, without notice. Sections that by their nature should survive termination — including Sections 3 through 16 and 18 through 22 — will survive.
19. Governing Law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, and, where applicable, by the federal laws of the United States.
20. Dispute Resolution; Arbitration; Class-Action Waiver
Please read this Section carefully — it affects your legal rights.
20.1 Informal resolution first. Before starting any formal proceeding, you agree to contact us via our contact form and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
20.2 Binding arbitration. Except as provided below, any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be settled by final and binding arbitration administered in New York, New York, before a single arbitrator, under the rules of a recognized arbitration provider (such as the American Arbitration Association).
20.3 Class-action and jury-trial waiver. To the fullest extent permitted by law, you and the Company agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You and the Company waive any right to a jury trial.
20.4 Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in court to protect its intellectual property or confidential information.
20.5 Time limit. To the fullest extent permitted by law, any claim arising out of or relating to the Service or these Terms must be filed within one (1) year after it arises, or it is permanently barred.
21. International Users
The Service is controlled and operated from the United States. If you access it from elsewhere, you do so on your own initiative and are responsible for compliance with your local laws. This document is provided in English; in the event of any translation, the English version controls.
22. General
These Terms, together with the Privacy Policy, are the entire agreement between you and the Company regarding the Service. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them freely. The Company Parties are intended beneficiaries of the disclaimers, limitations, release, and indemnities in these Terms. We are not liable for any failure or delay caused by events beyond our reasonable control.
23. Acknowledgement
By using the Service, you acknowledge that you have read and understood these Terms — and in particular Sections 3 (Opinion and Entertainment Only), 4 (Assumption of Risk), 6 (Affiliate Disclosure), 7 (Conflicts of Interest), and 12 (Limitation of Liability) — and that you accept full and sole responsibility for any decision you make in connection with the Content.
